Effective work with debts in a pre-trial manner

Andersen is a global developer of software solutions for medium and large businesses. One of its projects concerned the creation of software for a large financial institution in Kazakhstan (hereinafter referred to as the Counterparty). After fulfilling all the terms of the contract, Andersen faced the Counterparty's refusal to pay the amount of the debt due to internal corporate procedures. The debt amounted to 70,727,549 tenge (about 123,111 euros). Andersen contacted the Kazakhstan office of REVERA with a request to collect the debt.

What did we do?

  • Prepared and sent a claim to the Counterparty
    Drew up a Certificate of Completion of Work on the unilateral acceptance of the result of the work and a pre-trial claim, outlining Andersen's position and the demand for payment.
  • Conducted negotiations with the Counterparty
    Conducted communication on behalf of Andersen to achieve a pre-trial solution.
  • Resolved the issue without going to court
    During the negotiations, the Counterparty agreed to pay the entire debt as soon as possible.

Result: The Counterparty fully fulfilled its obligations and paid the amount of the debt without additional judicial intervention.
