A tax declaration for registration must be filed with the tax authority at the location of the bank, accompanied by notarially certified copies of documents specified in paragraph 2 of Article 76 of the Tax Code, these include:

  • founding documents;

  • documents confirming state registration in the country of incorporation of the non-resident, with the state registration number (or its equivalent);

  • minutes of the meeting of the board of directors or a similar governing body;

  • information about the beneficial owner;

  • power of attorney for document submission.

If documents are certified by a foreign notary, such documents must be apostilled according to the Hague Convention or legalized through consular institutions.

In the case of documents certified by notaries of the Russian Federation, Armenia, Belarus, Kyrgyzstan, Moldova, Tajikistan, Turkmenistan, Uzbekistan, and Ukraine, according to the Minsk Convention, such documents are accepted in the territories of these countries without any special certification. The notarially certified and apostilled/legalized documents must be translated into Kazakh and Russian languages.

Timeline

Regarding the timeline, opening a bank account can take from 5 working days (including obtaining an IIN, BIN, internal bank check) to a month, depending on the internal requirements of each bank. Additionally, it is advisable for the company’s first executive to be present when submitting documents for opening an account due to the necessity to sign a sample signature card and stamp the company’s seal. However, if the executive cannot be present, we can open an account for a representative by power of attorney, after which the power of attorney is usually revoked by the client and sends their sample signature card (notarially certified, or personally signed at the bank).
