Legal Alert: Electronic Entry Authorization for Kazakhstan (QazETA) — New Rules and Rejection Risks

The Government of the Republic of Kazakhstan is introducing a mandatory electronic entry authorization for stateless persons and foreign citizens arriving under a visa-free regime, including citizens of the Russian Federation and other EAEU (Eurasian Economic Union) countries. The official basis is the Resolution of the Government of the Republic of Kazakhstan No. 890 dated October 10, 2026, which established the operation of the digital pre-screening system QazETA.A detailed launch schedule for the system, the grounds for automatic rejection, and the categories of individuals who risk being stopped at the border are analyzed below.

📅 System Implementation Schedule:

The transition to the new framework will be phased to allow travelers time to adapt to the changes. Until the rules are fully enforced, the absence of the document will not serve as a ground for a refusal of entry at the border.

Deployment Phase Start Date Scope of Application Requirement Status
Phase 1 November 1, 2026 Aktau International Airport and 4 highway checkpoints on the border with Russia («Urlyutobe», «Aukhatty», «Atameken», «Nurly Zhol») Information stage (rules are simply explained at the border)
Phase 2 January 1, 2027 International airports of Astana and Almaty cities Information stage
Phase 3 March 1, 2027 All other border checkpoints across the country (air, highway, rail) Information stage
Phase 4 July 1, 2027 The entire state border of the Republic of Kazakhstan Strictly mandatory (entry will be denied without authorization)

⚙️ Basic Parameters of the Authorization:

  • Application deadline: Exclusively in advance — no later than 72 hours prior to the planned border crossing.
  • How to apply: Remotely via the official website of the QazETA digital platform or the mobile application of the same name. Applicants will need to fill out a questionnaire and undergo digital identity verification.
  • Cost: During the pilot phases, processing is entirely free of charge (0 KZT).
  • Validity period: The document is issued for 180 days (approximately 6 months) and allows multiple entries during this period.
  • Who does NOT need to apply: Children under 16 years of age; transit passengers (up to 3 days); diplomats; foreigners who already hold a valid Kazakhstani visa, TRP (Temporary Residence Permit) or Permanent Residence Permit.

🚫 Legal Grounds for Denial of Authorization:

The QazETA digital platform is directly synchronized with the databases of the Ministry of Internal Affairs (MVD) and the National Security Committee (KNB) of Kazakhstan. Internal affairs and national security agencies will approve an application only if the applicant does not violate the migration and legal regulations of the republic. The system will automatically block the issuance of the authorization for reasons prescribed in Article 48 of the Law of the Republic of Kazakhstan «On Migration of the Population», in particular:

  • Unpaid debts (fines) in Kazakhstan. The existence of any outstanding administrative fines (for example, for violation of stay regulations, traffic violations, or smoking in designated prohibited areas — a fine starting from 11,000 KZT / ~21 EUR) or tax liabilities from previous periods of stay.
  • Violation of the «90/180» rule (exceeding the period of stay in the country). If a foreign citizen has already exhausted the legal limit of stay in the republic. By law, citizens of the EAEU, including Russians, can stay in Kazakhstan without a visa and a TRP for a total of no more than 90 days within any half-year period (180 days).
  • Past judicial expulsion. If a Kazakhstani court has previously issued a ruling on the compulsory expulsion of a foreign citizen from the country or on return under a readmission agreement (in this case, an automatic ban on entry remains in effect for 5 years).
  • Criminal history and security threats. The presence of an outstanding or unexpelled criminal record, being on an inter-state wanted list, or suspicions by the National Security Committee (KNB) of the Republic of Kazakhstan regarding involvement in extremist activities, terrorism, actions against the sovereignty and constitutional order of the Republic of Kazakhstan, calls for violating the unity and integrity of the state’s territory, and/or inciting discord (inter-ethnic, inter-confessional, and/or religious enmity).
  • Unfiled tax return. If, during a previous period of residence in the Republic of Kazakhstan, a foreign citizen was required to submit an individual income tax return but failed to do so.
  • Errors in documents. Provision of false information, typographical errors in personal data, or using another person’s passport.

⚠️ Who Falls into the «Risk Zone»?

The following categories of citizens face difficulties with automatic approval and run the highest probability of receiving a rejection:

  • Those practicing «visa runs» and overstayers: Foreigners who attempt to live in Kazakhstan year-round by simply crossing the border for a single day and returning, without obtaining an official status (TRP or Permanent Residence Permit) and/or those who confuse day calculations under the «90/180» rule. With tight day-tracking via QazETA, this scheme will definitively stop working: the implemented system will immediately block the issuance of an authorization if the limit of legal days of stay has been exhausted.
  • Inattentive tourists / forgetful payers: Persons who left Kazakhstan with pending fines or forgot to pay any fine (even a minor one, such as improper parking or smoking in an unauthorized location). The debtor database will now block their access to obtaining an authorization as early as the stage of filling out the questionnaire at home.
  • Foreigners with legal issues: Those with an active criminal record, individuals involved in ongoing criminal cases, individuals placed on wanted lists, or those subject to exit bans in their home country (the databases of law enforcement agencies in EAEU countries may be partially integrated).
  • Citizens replacing TRPs with frequent trips: Those who utilize short-term visits for work or business purposes without obtaining an official employment contract and a TRP.
  • Those who made mistakes in the questionnaire: Since the application process requires undergoing a digital identity verification procedure, providing inaccurate data, typographical errors in the passport number, or discrepancies in uploaded documents will also result in an automatic rejection of the application.

Important: If you do not fall into any risk groups, have no debts in the Republic of Kazakhstan, and have not broken the law, obtaining the authorization will be a standard, fast, and free formality. Furthermore, an adaptation period is in effect until July 1, 2027 — if you do not have the authorization, border authorities will simply conduct educational/explanatory work and allow you entry anyway. After this date, entry without it will be completely closed.

Main Conclusion: The electronic authorization does not replace standard border control rules; rather, it shifts them into an online format. For law-abiding foreign citizens who do not violate stay limits and the laws of the Republic of Kazakhstan, the new system will allow them to pass through border checkpoints faster and without unnecessary questions.
